Herefordshire Council is being sued for £1 million in damages at London’s high Court, by a couple who claim the council forced them to close their care home in Ross-on-Wye.
Parvin Menon, 68, and his wife, Madhu Menon, 61, ran Rosedale Residential Home, in Ashfield Crescent, when they were arrested by police in connection with alleged failures in care at the home, but were not charged.
Council officers arrived at the care home on May 11th, 2010, and spent the day telling residents and relatives they ’had to be placed at a home other than Rosedale’.
Rosedale eventually re-opened in April 2012 but the couple want compensation for the damage done to their business by nearly two years of closure.
Kelvin Rutledge QC, for Herefordshire, said the council had genuine concerns the home ’was failing’ and had poor ratings from the regulator.
Herefordshire Council denies the couple’s claims and the hearing continues.
