The Obilash resturaunt, on Gloucester Road, Ross-on-Wye, has been fined over £3,000 after failing to dispose of waste correctly on January 4th, 2018.

Members of the Obilash Indian restaurant failed to appear in court on August 21st, 2018, so the following charges were proved in their absence:

• Muhammad Aziz Ltd failed to take all reasonable measures to transfer controlled waste to an authorised person or to a person authorised for transport purposes.

• Muhammad Aziz Ltd was found to have failed in his duty of care to transfer business waste to an authorised person and secure the transfer with a written description of the waste.

Hereford Magistrates found the matter proved in the absence of Muhammad Aziz Ltd and he was fined £3,000 (£1,500 for each offence).

He was also fined costs of £664.24, and a victim surcharge of £170.

In total, he was fined £3,834.24, to be paid by September 18th, 2018.

A spokesperson for Herefordshire Council said: “All businesses must ensure appropriate duty of care measures are in place so the waste they produce is disposed of correctly. Businesses must also have documentation to show who they have transferred the waste to and keep those records for at least two years.

“Household Recycling Centres may only be used by residents in Herefordshire wishing to dispose of their own household waste. The deposit of commercial waste (any waste associated with a business) is unlawful at Household Recycling Centres and can result in prosecution.”
