A restraining order served on local businessman, James Walter Jay, of Hentland, Ross-on-Wye, in June 2016, was successfully amended at Hereford Magistrates Court on June 13th, in favour of Malcolm and Barbara Harris, of The Lodge, Kynaston, Ross-on-Wye.

The order was also extended from two to five years.

The Court found that Mr Jay had breached the terms of the original order, served in June 2016, and had continued to harass and cause distress to Mr and Mrs Harris.

They claimed he had been making unnecessarily frequent ‘inspection’ visits to a septic tank, serving his property, sited on their land – up to once every four weeks.

The restraining order was amended on June 13th, 2017 so that James Jay cannot enter any land owned by Mr or Mrs Harris and cannot instruct anyone else to enter their land unless this had been prearranged and agreed through their solicitor.

Mr Harris told the Ross Gazette “After a most arduous time we are grateful and relieved that common sense prevailed and the Court has seen fit to put an end to an intolerable situation.”

His wife added:?“We are relieved that, after 24 years we have finally secured our basic right to live peacefully in our own home. There are still other issues that need to be resolved but we now feel confident that justice will prevail.”
