Herefordshire Council are currently in an ongoing court case, which is being dealt with at The High Court in London; the couple who owned the Rosedale Residential Home in Ross-on-Wye are attempting to sue the Council for £1 million in damages, as they claim the council forced them to close their care home.
A spokesperson at Herefordshire Council said: "Concerns about potential risks to residents at the home were highlighted in 2009, by both the council and the Care Quality Commission (CQC), following which necessary steps were taken to facilitate the relocation of vulnerable residents. Subsequently, the standard of care provided by the home improved and the council has since placed residents in the home and still uses it today.
"The council takes the safeguarding of all vulnerable children and adults in its care extremely seriously and as such has no reservations about taking appropriate action within its legal capabilities to ensure their continued protection."
