RENE Keogh, a resident of Kings Caple, has defeated Herefordshire Council in a significant ruling at the High Court, in London, over planning permission granted for polytunnels in the village.
Both Herefordshire Council and the farmer, Mr Neil Cockburn, of Pennoxstone Court, Kings Caple, have now consented to the judgement of the Judicial Review meaning the Council will now be liable for a sum speculated, but not confirmed, to be in the region of £100,000 including legal costs. The original planning permission has been quashed but the application still stands and will, once again, go before Herefordshire Council planning committee, although no date has been set for when a decision will be made.
A Herefordshire Council spokesman said: "We accept the view of the High Court. We treat all planning applications in the same, rigorous manner, and this application will be treated in the same manner as all other applications."
