Ross resident Mike Barnard was amazed and annoyed when he discovered that he had been given a parking ticket for over-staying in a parking bay in Broad Street. He immediately appealed to Herefordshire Council and refused to pay the fine. However he was delighted this week when he received a letter from the Traffic Penalty Tribunal adjudicator to say that his fine had been cancelled.

Mr Barnard had parked in Broad Street on May 24th, in order to drop off his wife's inhaler. He says he was parked for not more than two minutes before he went home. He then returned to the same street within a short time after he received a phone call to collect a replacement phone from a shop in Broad Street.

He told the Ross Gazette that he was parked for no more than five minutes while he picked up his order. He told the tribunal that the total time he was parked in that street on that day was far less than the 30 minutes permitted and in any event on the second occasion he parked in a different place on the opposite side of the street.

Mr Barnard was issued with a Penalty Charge Notice for being re-parked in the same parking place or zone within one hour of leaving. The signs in the street say that there is no return within one hour but he appealed and wrote explaining why to Herefordshire Council.

However the adjudicator agreed with Mr Barnard that the notices did not mean the whole street. He said:?" It is presumed these signs are located adjacent to each bay or "length of road" as specified in the Schedules. I find they do not relate to the whole street and they do not prevent a motorist from returning within the hour and parking in another bay in the same street. The alleged contravention of "Re-parked within the same parking place within one hour of leaving" did not occur and the PCN is unenforceable and should be cancelled."
